New Regulations for Old Conflicts
Phase I
- AGICOA Urheberrechtsschutz GmbH will inform both parties again of the existence of a double registration. Both parties may confirm or withdraw the registration per title within a period of ninety (90) days.
- If either party confirms, and the other party withdraws the claim, the double registration is solved.
- If both parties withdraw the claim, the funds blocked for the double registered work will be released and be added to the reserves.
- Non-reaction by either party will be treated
as withdrawal.
Phase II
If both parties confirm their claim, they will be asked to provide prima facie evidence for their claim by submitting written documents within sixty (60) days.
Phase III
- If, by expiration of the 60-day period, either party submits documents of the basis of which the claim seems to be established and if the other parties involved did not react to the request, AGICOA Urheberrechtsschutz GmbH will inform the same and/or their collecting societies that AGICOA Urheberrechtsschutz GmbH will release the double registrations if the outstanding documents are not submitted within an additional period of thirty (30) days.
- If also such additional period expires without any documents having been submitted, AGICOA Urheberrechtsschutz GmbH will release the double registrations and pay the blocked amount with discharging effect to the party which reacted and furnished prima facie evidence for its claim.
Phase IV
If, within the period of sixty (60) days (Phase III/2), more than one party involved submits written documents, AGICOA Urheberrechtsschutz GmbH will not decide on the legal claim, but will inform the parties involved about the reactions, asking them to settle the conflict directly between and among them.
